Trademark Updates: Effective January 1, 2025

Starting January 1, 2025, current federal trademark owners as well as current and prospective applicants should be informed of the new fees and updates regarding the United States Patent and Trademark Office (USPTO).

These deadlines relate to USPTO filing fees, the USPTO ID Manual, and the transition from the Trademark Electronic Application System (TEAS) to Trademark Center.

The USPTO Id Manual allows users to research class descriptive language related to proposed goods and services. This Manual is a critical part in the strategy for new applicants who are seeking registration.

The Trademark Center (which will replace the TEAS) will allow users to search the USPTO database as part of a clearance process prior to application, facilitate submission of applications and other filings in connection with registration and assist users in the management of their trademark applications and portfolios.

A few important dates:

  • Regarding in-progress TEAS initial applications: In-progress applications must be submitted by 11:59 p.m. ET on December 31,, 2024.
  • Regarding the expiration of TEAS: January 17,, 2025 will be the last day to file an initial application in the existing TEAS system, and the last day to apply under the current fee schedule..
  • Regarding the transition to the Trademark Center: Users must complete all electronic signature requests and submit any draft applications by 11:59 p.m. ET on January 17, 2025. Thereafter, TEAS will be retired, and Trademark Center will be the only place to submit trademark applications and related filings.
  • Regarding the new fees. All new fees will be in effect as of January 18, 2025.

While most of the initial filing fees associated with an application will remain the same, one significant increase is for filings related to intent to use applications. In addition, there are a number of increases in post-registration and maintenance related filings. The attorneys at JRG are available to discuss the details regarding the fee updates.
